The non-smoking regulation appears rational on its face and since the defendant has not challenged the “prima facie” rationality by specifying any irrational aspects of the regulation, we hold that the rule is valid and enforceable.
Rule of Law:
The right to privacy does not cover firefighters smoking cigarettes, either on or off of the job.
